In Ohio, felony crimes have five degrees of severity, with first-degree felonies being the most serious and fifth-degree felonies the least. The potential sanctions are based on the degree of severity:
- First-degree felonies — have a sentence range of 3 to 11 years in prison and a maximum fine of $20,000
- Second-degree felonies — have a sentence range of 2 to 8 years in prison and a maximum fine of $15,000
- Third-degree felonies — have a sentence range of 9 to 36 months (1 to 5 years for certain third-degree felonies) in prison and a maximum fine of $10,000
- Fourth-degree felonies — have a sentence range of 6 to 18 months in prison and a maximum fine of $5,000
- Fifth-degree felonies — have a sentence range of 6 to 12 months in prison and a maximum fine of $2,500 in fines
- Murder and aggravated murder — are considered the most serious crimes and are not categorized by degree of severity. Murder has a sentence range of 15 years in prison to life in prison without the possibility of parole; an aggravated murder conviction can impose a death sentence to life in prison with the possibility of parole after 20 years.
